Judgment
The petitioner is seeking anticipatory bail in complaint
case No. NACT-19-2016 dated 25.01.2017 under Section 138 of
Negotiable Instruments Act.
Learned counsel for the petitioner contends that the
petitioner had earlier been granted bail by the trial Court and had
been appearing before the trial Court regularly. He had sought
exemption from his appearance from the Court on few occasions
as the petitioner is a Government Teacher. The application of the
petitioner was dismissed and non bailable warrants were issued
for his appearance before the Court.
This Court, by the order dated 13.10.2017, had
directed the petitioner to appear before the trial Court and on his
doing so, he was ordered to be released on interim bail to the
satisfaction of trial Court.
Learned counsel for the petitioner contends that
petitioner had appeared before the trial Court and has been
released on interim bail by the trial Court.
In view of the above and without expressing any
opinion on the merits of case, the order dated 13.10.2017,
granting interim bail to the petitioner, is hereby made absolute.
However, the petitioner shall abide by the conditions envisaged
under Section 438(2) Cr.P.C.
The petition stands disposed of accordingly.
