The petitioner through the instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondents to register him for the purpose of custom milling.
The petitioner has purchased a Rice Mill from Punjab and Sind Bank in open auction. The said bank auctioned Rice Mill of M/s Raj Rice Mills on account of pending recovery. The respondent is not registering petitioner for the purpose of allotment of paddy on the ground that it has purchased mill from a defaulter.
Notice of motion.
Mr. Aman Dhir, DAG, Punjab, who on advance notice is present in Court, accepts notice on behalf of respondents-State and waives service.
With the consent of both the parties, the matter is taken up today itself for final disposal.
Learned State counsel expressed his inability to controvert the fact that case of the petitioner is squarely covered by judgment dated 25.07.2023 passed by this Court in M/s Ashirwad Industries Vs. State of Punjab and others, CWP-18743-2020 as well as Clause 7(a) xi of the Punjab Custom Milling Policy Kharif 2023-2024.
In the wake of statement of learned State Counsel, the present petition stands disposed of with a direction to respondents to consider claim of petitioner in the light of judgment of this Court in M/s Ashirwad Industries
(Supra) as well as aforesaid Clause of Custom Milling Policy.
