Heard Sri.Rajashekara R. V., learned counsel for the petitioner/accused and learned High Court Government Pleader for the respondent/State.

It is submitted that trial is concluded to a major extent and only cross examination of investigation officer is pending.

Taking note of the fact that none of the material witnesses on behalf of the prosecution have supported the case of the prosecution, continuation of the accused in the judicial custody is no longer warranted.

Other apprehensions of the prosecution can be met with by imposing suitable and stringent conditions.

Accordingly, the following:

ORDER

i. Bail Petition is allowed.

ii. Accused is directed to be enlarged on bail on executing a bond in a sum of Rs.1,00,000/-with two sureties for the likesum to the satisfaction of the Trial Court.

iii. Accused shall appear before the Trial Court regularly.

iv. Accused shall not leave the jurisdiction of Bengaluru Urban District without prior permission.

v. Accused shall not interfere with the true course of justice.

Violation of any one of the above conditions would entitle the prosecution to seek for cancellation of the bail.
