By order dated 20.05.2005, a Division Bench of this Court stayed further proceedings against the petitioner. Order dated 20.05.2005 reads as:

“Respondent No.4 is stated to have been served through dasti process. He is neither present in Court in person nor represented through counsel. Respondent No.4 is accordingly, proceeded against ex parte.

Learned counsel for respondents No.1 to 3, was confronted with the conclusions arrived at by the Senior Superintendent of Police, in his report, which has been placed on the record of this case as Annexure P.5. Despite the aforesaid, learned counsel for the respondents has invited our attention to the following observations made in the impugned order dated 8.12.2004 (Annexure P-8):-

"ASI, Guljar Ram No.286/FGH being on responsible post by harassing and beating the complainant without any reason has misused his official position which is grave violation of discipline and rules of police department. By doing such, this employee has caused damage to the respect of police department in the public."

On our query, from learned counsel, to inform us the material on the basis of which the allegations of harassment and beating, levelled against the petitioner by the complainant can be substantiated, learned counsel for the respondents seeks an adjournment so as to enable him to file a detailed written statement.

In view of the above, proceedings of this case are deferred to 18.7.2005. Written statement if any be filed within two weeks from today with a copy in advance to the counsel for the petitioner.

In the meantime, further proceedings against the petitioner shall remain stayed.”

Learned counsel representing the petitioner submits that petitioner superannuated on 31.10.2020 as Sub Inspector. He is getting pension, thus, instant petition has rendered infructuous.

Learned State counsel does not dispute the aforestated factual and legal position.

In the wake of statement of both sides, the petition stands disposed of.

Pending application(s), if any, shall also stand disposed of.
