Judgment

This is a bail application U/S.483 of BNSS by the petitioner for grant of bail in connection with Jharsuguda PS Case No.98 of 2026 corresponding to CT Case No.349 of 2026 pending in the file of learned SDJM, Jharsuguda, for commission of offences punishable U/Ss.112(2)/ 317(2)/ 317(4)/ 317(5)/ 61(2)/ 3(5) of BNS, on the main allegation of committing online financial fraud, along with co-accused persons in connivance with each other.
Heard, Mr. Ajit Kumar Raut, learned counsel for the petitioner and Mr. S.C. Pradhan, learned Additional Public Prosecutor in the matter and perused the record.
After having considered the rival submissions upon perusal of record, it appears that the petitioner appears to be an associate of Md. Sadab Hamdam, who has been described as the principal accused in the charge-sheet and it is ascertained in the course of investigation that the said Md. Sadab Hamdam was sending money to the present petitioner through different electronic modes and the present petitioner on his instruction was allegedly sending money to different persons. Further, the present petitioner has also allegedly engaged one Aman Bharti for the same purpose. The petitioner is in fact detained in custody since 24.02.2026, but in the meantime, charge-sheet has already been submitted, however, there is no criminal antecedent reported against the petitioner. In the aforesaid facts and circumstances and taking into account the pre-trial detention of the petitioner in custody and keeping in view the other circumstances on record in entirety including the inherent right of the accused-petitioner to be presumed innocent until proven guilty at the trial, this Court without expressing any view on merit, admits the petitioner to bail.
Hence, the bail application of the petitioner stands allowed and the petitioner is allowed to go on bail on furnishing bail bonds of Rs.50,000/- (Rupees Fifty Thousand) only with two solvent sureties each for the like amount to the satisfaction of the learned Court in seisin of the case on such terms and conditions as deem fit and proper by it with following condition:-
the petitioner shall co-operate the trial.
Accordingly, the BLAPL stands disposed of. A soft copy of this order be immediately communicated to the concerned Court, who shall afterwards communicate the same to the concerned Jail through e-mail for reference.
