Judgment
Ravindra Maithani, J
Applicant is in judicial custody in FIR No.529 of 2022, under Sections 8/20 of the Narcotic Drugs and Psychotropic Substances Act, 1985, Police Station Gangnehar, District Haridwar. He has sought his release on bail.
Heard learned counsel for the parties and perused the record.
Counter affidavit is taken on record. IA No.1 of 2024 stands disposed of accordingly.
This is the second bail application of the applicant. The first bail application has been dismissed as withdrawn on 01.05.2024.
According to the FIR, on 12.07.2022, 1.950 kg. Charas was allegedly recovered from the possession of the applicant.
Learned counsel for the applicant would submit that applicant was arrested along with co-accused Danish. The co-accused Danish having similar role has already been granted bail.
Learned State Counsel admits this fact.
Having considered, this Court is of the view that the applicant deserves to be enlarged on bail.
The bail application is allowed.
Let the applicant be released on bail, on his executing a personal bond and furnishing two reliable sureties, each of the like amount, to the satisfaction of the court concerned.
