Learned counsel appearing for the petitioner submits that he does not object to the written statement being taken on record, subject to adequate cost to be imposed upon respondent.
Learned counsel appearing for the respondent submits that the cost imposed may be reasonable.
In addition to the cost which has been imposed by the learned Trial Court, interest of justice would be sub-served, if a further cost of Rs. 10,000/- is imposed upon the respondent, to be paid to the petitioner within two weeks from today.
The impugned order is modified to that extent.
The written statement is directed to be taken on record.
Replication, if any, may be filed within the next four weeks.
The learned Trial Court to proceed in accordance with law, upon receipt of this Order.
The petition along with pending application is disposed of in the above terms.
