Judgment
Anoop Chitkara, J
The petitioner, who is already on interim bail granted upto 16.12.2020 at 3:00 PM, by learned Special Judge, Shimla, in bail application No. 199-S/22
of 2020, has come up before this Court seeking regular bail.
While granting this interim bail, learned Special Judge had put on stipulation in paragraph-7, which reads as follows:-
In these circumstances, the present application is allowed and conditional/interim bail for two weeks is granted subject to furnishing personal bond in
the sum of Rs. 2 lacs( Rs. two lacs) with two sureties each of the like amount to the satisfaction of the learned Illaqua Magistrate/Judicial Magistrate
Ist class, Court No. IV, Shimla. The bail-applicant shall surrender before the Superintendent Jail on 16.12.2020 before 3:00 PM. He will also furnish
the entire medical record before the Superintendent Jail"".
The petition is pre-mature and the petitioner must approach the learned Special Judge, Shimla for extension of time for furnishing bail before coming
to this Court.
At this stage, Mr. B.B. Vaid, learned counsel for the petitioner seeks permission to withdraw this petition with liberty to file fresh petition. Liberty
granted. This petition is closed, with liberty to file a fresh petition before the Learned Special Judge.
