Judgment
The present Appeal has been filed against the order dated 16.11.2018 of the State Consumer Disputes Redressal Commission, Delhi (for short “the State Commission”) in Complaint No.718 of 2016 whereby the right of the Appellants to file the Written Statement was closed on account of non-payment of cost imposed while condoning the delay in filing the Written Statement.
Learned Counsel appearing for the Complainants/Respondents No.1 and 2 and the learned Counsel appearing for the Respondent No.3 submit that they have no objection if the Appeal be allowed subject to costs.
In view of this submission on behalf of the learned Counsel for the Complainants who are the effected parties and in the interest of justice, the impugned order is set aside and a cost of 5,000/- is imposed upon the Appellants which shall be paid to the Complainants, i.e., the Respondents No.1 and 2 before the State Commission on the date fixed before it.
Since there is a delay due to pendency of this Appeal, it is expected that the State Commission shall expedite the matter.
With these directions, the present Appeal stands disposed of.
