I.A. No.35/2020 (application for condonation of delay filed by appellant)
The instant application is filed for condonation of delay in filing the present appeal. In the application the number of days of delay has not been mentioned. However, the counsel for the appellant stated that there is a delay of 155 days due to the merger of the appellant with Bandhan Bank Limited. After considering all facts, the application is allowed and the delay of 155 days in filing the appeal is condoned.
None appears on behalf of the respondents and the appeal is taken up on merit.
The respondent no.1 filed S.A. bearing no.13/2016 titled as Geeta Devi Jangid V. Gruh Finance Limited which was allowed vide impugned order dated 09.08.2019 passed by DRT, Jaipur.
Sh. Usha Singh, Advocate for the appellant argued that DRT, Jaipur has not discussed the material and evidence placed on record and allowed the S.A. bearing no.13/2016. It is further stated that DRT, Jaipur was required to pass a reasoned order after discussing relevant material brought on record and therefore the impugned order cannot be sustained and be set aside.
After considering all facts, the S.A bearing no.13/2016 is remanded back to the DRT, Jaipur for fresh judicial determination and disposal in accordance with law after giving reasoned judgment. DRT, Jaipur is also directed to issue notice to the concerned parties for appearance. The concerned parties are directed to appear before DRT, Jaipur on 24.08.2026.
