Learned counsel appearing for the applicant submitted that the validity of G.O.Ms.No.125, Environment and Forests (FR.5) Department, dated 31.08.2010 is now pending before the Hon'ble Supreme Court of India in 32 Special Leave Petitions. Learned counsel also pointed out that by the impugned order, the School has not been closed and it is not adverse to the running of the School.

Learned counsel appearing for respondent Nos. 1 and 2 also submitted that the respondents have no intention to close the School or to cause any obstruction to the running the School, except maintaining the Elephant Corridor and everything is now subject to the final orders to be passed by the Hon'ble Supreme Court of India.

Learned counsel appearing for the applicant submitted that liberty may be granted to the applicant and he may be permitted to withdraw the application with liberty to approach the Tribunal, in case the Hon'ble Supreme Court interferes with the G.O.Ms.No.125, dated 31.08.2010 or any obstruction is caused to the running of the School.

Permission with liberty granted and the application is dismissed as withdrawn with no order as to costs.
