Heard Mr. P.T.Sangma, learned counsel for the petitioner.
The prayer made in the writ petition is for a mandamus to issue to the State respondents for payment of 50% of the pension amount and retirement benefits to the petitioner who is stated to be the wife of the respondent No. 3 who has deserted her.
A perusal of the records reveals that as far back as 2007, the petitioner had approached the Court of the Magistrate 1st Class, West Garo Hills, Tura, for maintenance, which was allowed.
Mr. P.T.Sangma, learned counsel for the petitioner submits that after that period, no maintenance has been received nor any payment made to the petitioner by respondent No. 3.
Mr. R.Gurung, learned GA on behalf of the State respondent Nos. 1 & 2 has raised objection to the maintainability of the writ petition, and submits that the petitioner has alternative remedy for redressal of her grievances which is a continuing right.
The submission of the learned counsels are noted. As it is correct that the petitioner can take recourse to alternate remedy, this matter stands closed and disposed of by giving the petitioner the liberty to approach the correct forum for redressal of her grievances.
