The petitioner in this proceedings is represented by her guardian appointed under the National Trust for Welfare of Persons with Autism, Cerebral Palsy, Mental Retardation and Multiple Disabilities Act, 1999. The petitioner suffers from disability falling within the purview of the said Act.
The father of the petitioner died in a motor accident. Compensation was awarded by the Motor Accidents Claims Tribunal. The Award amount was deposited in nationalised Banks. The prayer of the petitioner is for transferring the amounts deposited in the Banks to the treasury account of the petitioner since that will fetch more interest. Ext P5 request has been submitted in the said regard before the District Collector who is the Chairman of the respondent committee.
Having heard the learned counsel for the petitioner and the learned senior Government Pleader, it is deemed only appropriate that urgent orders be passed in the application seeking for re-deposit/ transfer of the amount to the treasury account. The respondent shall take a decision in the said regard on ascertaining the necessary details regarding the nature of deposit, rate of interest etc and pass appropriate orders, as expeditiously as possible and at any rate within a period of one month from the date of receipt of a copy of this judgment.
The petitioner shall produce a copy of the Writ Petition along with the copy of the judgment before the District Collector, who is the Chairman of the committee for compliance.
