Judgment
Heard Learned Sr. Counsel for the Appellant as well as Learned Counsel-Mr.Gaurav Mitra, Advocate for RP and Ms. Pooja Mahajan, Advocate for Greenpolis Welfare Association.
The reliefs sought in this Appeal are that direction be issued to the Adjudicating Authority to expeditiously deal with I.A. No. 798 of 2023 filed by the Appellant-Greenpolis Welfare Confederation in CP(IB) No. 2721 of 2019; Further direction to Adjudicating Authority not to order any Committee of Creditors to be convened till I.A. No. 798 of 2023 is adjudicated.
Admittedly in I.A. No. 798 of 2023 filed by the Appellant, notices have already been issued and same is pending consideration. Since Application is still pending, we see no reason to entertain this Appeal, it is for the Adjudicating Authority to consider the I.A. No. 798 of 2023 and other Applications pending as it deems fit and proper in accordance with law. Looking to the issues raised, ends of justice will be served if the Adjudicating Authority endeavors to dispose of the Applications at an early date.
With the above observations, the Appeal is dismissed.
