Ranjan Gogoi, C.J. (Oral)

1.

This writ petition has been filed seeking the following principal relief: b)directing the respondent Nos.1 to 5 to get the Harijan Colony in Village Kaler Kalan, constructed under the Indira Vikas Yojna by the Centre Government for providing shelter to weaker Sections and landless labourers, of Village Kaler Kalan, vacated from respondent Nos.6 to 43 who are unauthorized occupants, who have not been allotted the houses in the Colony, but are occupying the same illegally, and to implement the order dated 24.03.2009 (P-2) passed by Deputy Commissioner, Gurdaspur, directing the respondent Nos.2 to 5 Civil Writ Petition No. 1128 of 2010 to get the colony vacated and get the possession of same to original allottees who are residents of Village who have in fact been allotted the houses, by the B.D.P.O. Dhariwal, as per the list circulated by the authorities.

We are told by Shri Alok Jain, learned Additional Advocate General, Punjab, that on 12.3.2012 orders have been passed under the provisions of the Punjab Public Premises and Land (Eviction and Rent Recovery) Act, 1974 for eviction of the respondents No. 6 to 43 and 10/12 other persons who were also found to be in unauthorized occupation of the premises in question.

2.

Having regard to the relief prayed for in the writ petition, which has been extracted above, the order of eviction dated 12.3.2012 would amply take care of the said relief and nothing further would survive for consideration in this writ petition.

3.

We, therefore, close this writ petition by observing that the order of eviction passed on 12.3.2012 will now be brought to its logical conclusion by following the provisions of law as may be applicable in this regard. The writ petition stands disposed of in the above terms.
