Judgment
B.R. Arora, J.—Heard learned Counsel for the parties.
Counsel for the parties submit that this case is squarely covered by the judgment of this Court in : Banner Zila Bihar Pradesh Shiksna Parishad, Sripalpur Shikshak Sangh v. The State of Rajasthan and Anr. S.B. Civil Writ Petition No. 4301 of 1989 and B.T.C. Utima Pariksharathi Sangh v. The State of Rajasthan and Ors. S.B. Civil Writ Petition No. 2320 of 1990 and this writ petition may be decided in terms of these judgments.
As the present case is squarely covered by the judgments of this Court in the aforesaid two cases, the present writ petition is, therefore, decided in terms of the above two judgments.
Accordingly the writ petition is allowed. The respondents are directed to consider the persons named in the Schedule, who produced the certificate of B.T.C. from Bikar Pradesh Shiksha Parishad, Sripalpur, obtained prior to October 13, 1987, by considering them duly eligible and qualified for the purposes of the appointments on the post of teachers Grade JOT and to appoint them, if otherwise found suitable. However, the appointments given to these persons will, also, be subject to final out-come of the investigation that may be carried-out in pursuance of the directions, issued by this Court in Rakshpal Ram''s case D.B. Civil Writ Petition No. 841 of 1988.
