Judgment
Petitioner has filed this writ petition challenging order dated 22/11/2018 contained in Annexure P/15. By said order, memorandum of chargesheet
has been issued to petitioner. Petitioner has challenged the chargesheet on the ground of competence of Vice Chancellor to issue the chargesheet.
Petitioner has earlier filed a writ petition bearing No. 1312/2019 before this Court. In the said writ petition, order dated 03/12/2018 was challenged,
by which petitioner was suspended by Vice Chancellor. In the said petition, order was challenged on the ground that Vice Chancellor is not competent
authority to institute departmental enquiry against the petitioner and place him under suspension. This Court vide its order dated 18/12/2019 dismissed
the writ petition and held that Vice Chancellor can initiate departmental enquiry and suspend the petitioner, however, punishment is to be imposed by
Board of Management.
As the issue involved in the present writ petition has already been decided in WP No. 1312/2019 vide order dated 18/12/2019, therefore, the present
writ petition, which has been filed by the petitioner, challenging competency of Vice Chancellor to issue chargesheet is also dismissed.
