Judgment
Having heard the learned counsel for the parties and on going through the records, we find that the application submitted by the applicant seeking
premature retirement is pending consideration before the Competent Authority and till date, no decision has been taken.
During the course of hearing of the matter, Shri S.S. Pandey, learned counsel for the applicant, indicated that for the present, the applicant would be
satisfied in case a direction is issued to the respondents to take a decision on the prayer made by the applicant for premature retirement within a
reasonable period of time.
Shri Harish V. Shankar, learned counsel for the respondents, made certain submissions with regard to the issues which were raised before the Delhi
High Court and argued that within a reasonable period of time the respondents would have no difficulty in deciding the application but no fixed time
limit should be granted. He further pointed out that the application seeking premature retirement filed by the applicant is already under consideration
and the respondents would make an endeavour to take a decision at an early date.
Having bestowed our consideration to the rival contentions of the parties, for the present, without expressing any opinion on the merits of the matter or
the contentions advanced by the learned counsel for the parties, we deem it appropriate to dispose of the matter directing the Competent Authority,
before whom the application for premature retirement filed by the applicant is pending, to consider the same in accordance with the rules and policies
applicable and take a decision on it in accordance with law, preferably within a period of two months and dispose of the application. Ordered
accordingly.
With the aforesaid, the OA stands disposed of.
