Judgment
Ram Mohan Reddy, J.—Petitioner, having lost his land measuring 1 acre 30 guntas in Sy. No. 80 of Nagadev anahalli village, Kengeri Hobli, Bangalore, notified for acquisition by the respondent-BDA for formation of a residential layout was subject matter of a Reference under Sec. 30 & 31 of the Land Acquisition Act, 1894, for short LA Act to the Civil Court, whence the Civil Court declared that the petitioner along with others were entitled to shares in the compensation. According to the petitioner, the Civil Court in LAC No. 154/99 by judgment and award dt. 22/2/2012 enhanced the compensation for land measuring 2 acres in Sy.No. 83 of Nagadev anahalli under the preliminary notification dt. 19/1/1989 and final notification dt. 9/1/1994 from Rs. 1,30,000/- per acre to Rs. 2,04,732/- per acre. Petitioner claiming that the acquisition of her lands and that of the land in Sy.No. 83, subject matter of LAC No. 154/99 under the very same notification, both preliminary and final invoked Sec. 28A of the Land Acquisition Act, by filing an application dt. 26/3/2012-Annex. C, acknowledged by the respondent-Annex. D, on the very same day but did not respond to the application. Hence this petition for a writ of mandamus.
Having heard the learned Counsel for the parties, perused the pleadings, the petitioner has made out a case for issue of a writ of mandamus. A direction shall ensue to the respondent to consider petitioner''s application Annex. C and pass orders in accordance with law, in any event on or before 14/2/2013.
