This Criminal Appeal is filed by Govindarajulu, who is A6 in this case.
A6 had filed suspension of sentence petition in Crl.M.P.No.869 of 2017. This Court, at the stage of admission on 24.01.2017, suspended the sentence imposed on A6 and granted bail, on condition of executing bond and further condition to appear before the Court on the first working day of every month at 10.30 a.m.
The learned Special Public Prosecutor for CBI submitted and filed status report submitting that A6 has not complied with the condition appearing before the Trial Court and hence to issue warrant to secure him. He further submitted that the said Govindarajulu, at the time of suspension of sentence, had given residential address as No.3, Flat No.9, M.G.Nagar, II Street, Ullagaram, Chennai – 600 009. On verification, it was found that the said A6 is presently residing at No.1-152, Near Post Office, Banala Vari Street, Nayanipalli, Vetapalem, Bapatla District, Andhra Pradesh – 523 187, along with his wife. As regards A6 is concerned, he is visiting his wife on and off and is absconding. However, given appropriate orders, he can be secured and produced before this Court. On earlier occasion, there was no representation for the appellant/A6, due to which, appeal of the other co-accused viz., A2, A3, A4, A5 and A6 could not be heard.
The learned Senior Counsel for A2 submits that A2 is suffering from heart ailments and only overt act attributed against him is the evidence of P.W.2 and stating that he has parted amount of Rs.25,000/- to A2 is in this case and nothing more.
In view of the above, this Court directs the respondent to secure the appellant/A6, wherever he is found, and produce him before this Court on 11.02.2026.
