Judgment
Srinivasan, J.—The Will in question Ex. B1 is dated 7.9.1977. Exultant died on 9.9.1987. Earlier on he executed a Will Ex. A13 dated
15.6.1970 and another registered Will Ex. A14 dated 7.1.1976. The genuineness of Ex. A14 is not disputed. The said Will is probated and the
appellants herein have not preferred any appeal against that judgment. As such the signatures of the Exultant are admitted signatures on Ex. A14.
If the signatures in Ex. A14 and Ex. B 1 are compared, it will be very clear even to the naked eye that the signatures found in these documents
are entirely different. It is sufficient to refer to the letter, Original in Tamil, in the word, Original in Tamil. The letter, Original in Tamil, found in Ex.
A14 is completely different from the one found in Ex. B1. Again the word, Original in Tamil, as found in Ex. A14, is totally different from that
found in Ex. B1. This shows that the signatures found in Ex. B1 give rise to considerable suspicion about the genuineness thereof. Though it may
not be necessary for me to go to the extent of holding that the signatures in Ex. B1 are forged, it is sufficient for me to hold that the suspicion which
has been aroused in this case has not been removed by the defendants who propounded the Will Ex. B1. The discussion of the evidence by the
lower appellate court also makes it clear that the genuineness of Ex. B1 has not been established by the defendants.
