Judgment
Heard Mr. Lukesh Kumar, learned counsel appearing on behalf of the petitioner.
Heard Mr. Naveen Kumar Gaunjhu, learned counsel appearing on behalf of opposite party-State.
Learned counsel for the petitioner submits that the petitioner is in custody since 15.10.2018 in connection with Goilkera P.S. Case No. 34/2017 for
alleged offence registered under Sections 25(1- A)/ 25(1-B)(a)/ 26(2)/35 of Arms Act, now said to be pending in the court of learned Additional
Sessions Judge-II, Chaibasa in S. T. Case No. 125 of 2019.
Learned counsel for the petitioner submits that earlier the bail application of the petitioner was rejected by this Court vide order dated 26.07.2019 in
B.A. No. 6207 of 2019 and he has renewed his prayer for bail considering the period of custody. However, he submits that one interlocutory
application being I.A. No. 5815 of 2020 has been filed for grant of provisional bail to the petitioner during the pendency of the present case as the
marriage of his sister will be solemnized on 08th December, 2020. He submits that the necessary document i.e. the marriage card has been annexed
along with the interlocutory application. He further submits that the petitioner is ready to surrender before the learned court below on or before 16th
December, 2020.
Learned counsel for the opposite party-State opposes the prayer for bail, but he has got no serious objection to the prayer made in I.A. No. 5815 of
2020 for grant of provisional bail to the petitioner.
After hearing the learned counsel for the parties and considering the fact that the marriage of the petitioner's sister is scheduled to be solemnized on
08th December, 2020, this Court is inclined to enlarge the petitioner on provisional bail upon furnishing bail bond of Rs. 10,000/- (Rupees ten thousand)
with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Chaibasa in connection with Goilkera P.S. Case
No. 34/2017, on the following conditions: -
(i) One of the bailors should be his mother/father.
(ii) The petitioner is directed to surrender before the learned court below on or before 16.12.2020 and file surrender certificate before this Court latest
by 18th December, 2020.
I.A. No. 5815/2020 is hereby disposed of.
Post this case on 08th January , 2021 for consideration of the bail application of the petitioner.
