Heard learned counsel for the petitioner.

The instant habeas corpus petition has been filed by the

petitioner, in which it is prayed that inspite of registration of FIR

on 21.02.2017, his minor daughter has not been recovered,

therefore, it is a case of illegal detention.

In our opinion, the FIR has been filed on 21.02.2017, in

which investigation is going on and if the petitioner is not satisfied

with the investigation, then he is required to make request to the

higher authorities of the police department.

Along with this habeas corpus petition, copies of three

representatives have been annexed, out of which one

representation was submitted before the Superintendent of Police,

Barmer, for proper investigation and for recovery of his daughter.

In view of the fact that FIR was filed on 21.02.2017, in which

investigation is going on, therefore, at this stage we are not

inclined to interfere in this habeas corpus petition, however, the

Superintendent of Police, Barmer, is directed to monitor the

investigation of F.I.R. No.26/2017 registered at Police Station-

Samdari, Distt: Barmer, on 21.02.2017.

The habeas corpus petition is, accordingly, disposed of.
