Judgment
This matter is taken up by virtual/physical mode.
The two writ petitions have been filed by the Governing Body of Regional College of Management and the RCM Trust. The said Trust is an educational agency recognized under the Odisha Education Act, 1969. It has obtained all statutory permissions, recognition and affiliation for admitting students and operating Technical and Management courses, which have not been withdrawn till now.
The grievance is directed against the orders dated 24.08.2021/25.08.2021 (Annexure 20 & 21) whereby on account of inter se dispute between the two Governing bodies of the educational agency, restrictions have been imposed on conducting further admission in the BBA, BCA, B.Sc. (ITM) and MFC courses offered by the college from the Academic Session 2021-22.
It is argued that all the statutory requirements are in place and the ground of dispute between the Management is extraneous for restraining the students to be admitted to the courses.
Issue notice for 07.12.2021.
Mr. A. R. Dash, learned counsel appears and waives notice on behalf of Opposite Parties.
Let requisite number of copies of both writ petitions be furnished to the learned counsel for the State during course of the day.
In the meanwhile, the operation of orders dated 24.08.2021/25.08.2021 shall remain stayed.
In the meanwhile, this Court hopes that the Secretary of Higher Education would take steps to resolve the issue, which primarily is the creation because of the decision of the Regional Director, Higher Education-OP No. 3.
