This matter is taken up through Hybrid mode.

Vakalatnama filed on behalf of Odisha Information Commission in Court by Mr. Bijaya Kumar Dash, learned counsel and associates is taken on record.

Petitioner is aggrieved by order dated 12th May, 2023 (Annexure-1) passed by the Odisha Information Commission in Second Appeal No.3228 of 2021, whereby the Information Commission while disposing of the Second Appeal, directed the Ex-PIO to submit proof of disposal of the online complaint case referred to by the Petitioner within one week under intimation to the Petitioner/Appellant and granting liberty to the Petitioner to file complaint petition under Section 18 of the Right to Information Act, 2005 for non-supply of the information sought for.

In course of hearing, Mr. Jena, learned counsel for the Petitioner submits that interest of justice will be best served if the Petitioner files a complaint under Section 18 (1) of the RTI Act for redressal of his grievances.

Mr. Dash, learned counsel for the Opposite Party-Commission does not have any objection to the above submission.

In view of the above, the writ petition is disposed of with an observation that in the event a complaint under Section 18(1) of the RTI Act is filed, the same shall be considered in accordance with law giving opportunity of hearing to the parties concerned.

Issue urgent certified copy of the order on proper application.
