W.P.(C) No.20122 of 2022 and I.A. No.10733 of 2022
Mr. Dash, learned advocate appears on behalf of petitioner and submits, his client stood transferred. However, due to health problem of his dependent wife, he retained the quarter. By impugned office order dated 5th August, 2022, three rates of licence fees have been imposed. For period between 14th June, 2022 till 13 August, 2022 licence fee has been increased to Rs.560/- per month and thereafter at the rate of Rs.2,800/- per month. On query from Court he submits, his client has applied for quarter in transferred location but it has not yet been allotted.
Mr. Sharma, learned advocate, Additional Government Advocate appears on behalf of State and submits, the office order has been duly issued following resolution taken by the finance department. His client will file counter.
Counter be filed by 26th September. Petitioner may file rejoinder on adjourned date upon advance copy served.
Mr. Dash prays for interim order. Concerned authority is restrained from deducting penal licence fees for period 14th August, 2022 onwards, till next date. Petitioner is put on notice that in event the challenge is rejected, he will become liable to pay the arrears immediately thereupon.
