Heard learned counsel for the parties.

By this OA, the applicant seeks rounding-off of disability element of disability pension from 20% to 50% for life along with arrears i.e. three years

prior to the date of filing of OA.

It is stated that the applicant is already in receipt of the disability element of disability pension 20% for life as evidenced by Annexure-1 at Page 19 of

paper book.

Counsel for the respondents submits that appropriate orders may be passed.

In view of the Govt. of India, Ministry of Defence letter No. 1(2)/97/D(Pen-C) dated 31.01.2001 and thejudicial pronouncement of the Hon'ble

Supreme Court in the case of Union of India Vs. Ram Atrtar (Civil Appeal No. 418/2012) decided on 10.12.2014, the applicant is entitled to the

benefit of rounding-off from 20% to 50% for life. However, the arrears are restricted to three years prior to the date of filing of the present OA i.e.

15th February 2019.

The respondents are directed to calculate, sanction and issue necessary PPO and pay balance arrears to the applicant within a period of six months

from the date of receipt of this order, failing which, it shall carry interest 8% per annum till the date of payment.

OA stands disposed of accordingly. No order as to costs.
