Petitioner is the wife of the respondent. Relationship between the parties is not in dispute. Since the petitioner is neglected to be maintained by the respondent, she filed a petition u/s 125 of Cr.P.C. The trial Court awarded Rs. 4,000/- per month towards maintenance. The revisional Court enhanced the maintenance to Rs. 4,500/- per month. This petition is filed by the wife seeking enhancement of maintenance. According to the petitioner, the gross salary of the respondent is Rs. 29,000/- per month.
Sri Patil, learned advocate appearing on behalf of the respondent submits that the respondent is retiring by the end of March 2013 and he may get pension at the most Rs. 7,000/- to 8,000/- per month. Since the respondent is retiring in March, 2013, an amount of Rs. 4,500/- awarded by the revisional Court cannot be said to be unreasonable under the facts of the case. It may not possible for the respondent to get more than Rs. 8,000/- per month as pension.
In view of the same, no interference is called for Accordingly, petition stands dismissed.
