Heard Mr. A.K. Sahoo, learned counsel for the Appellant and Ms. S.Mishra, learned Additional Standing Counsel.
This appeal under Section 14(A)(2) of SC & ST (POA) Act is for grant of bail to the appellant Gorelal Sahu @ Hira in connection with T.R. Case No.42 of 2020 arising out of Malkangiri P.S. Case No.336 of 2020 pending in the file of learned Additional Sessions Judge-cum-Special Judge, Malkangiri for alleged commission of offence under Sections306/376(2)(n) of the Indian Penal Code read with Section 6 of POCSO Act and 3(2)(v) of SC and ST (POA) Act.
It is submitted on behalf of the appellant that he has been falsely implicated taking advantage of physical relationship with the deceased. It is further submitted that the roommates of the deceased who are the key witnesses have not supported prosecution case in course of trial.
Having heard learned Additional Standing Counsel and considering the circumstances of the case and the statements of the witnesses so far examined in course of trial, as revealed from copies of their depositions, it is directed to release the Appellant on bail in the aforesaid case on such terms and conditions to be fixed by the learned court in seisin over the matter including the condition that, the Appellant shall not be involved in any other offence while on bail and shall attend the trial court on each date fixed.
The CRLA is accordingly disposed of.
An urgent certified copy of this order be issued as per rules.
