Gordhan Dass vs Babu Ram and another

Goyal, J.—This revision u/s 15 of the Haryana Urban (Control of Rent and Eviction) Act, 1973 has been filed against the order of the Rent Controller refusing to set aside the exparte order of ejectment. From the perusal of the registered letters sent to the petitioner and stated to have been refused, it is revealed that both of them were addressed to him at Bhiwani address, c/o M/s. Goverdhan Lal Roshan Lal, which was obviously a device to secure exparte order because the shop is situated at Dadri and the tenant was running that shop. On the second registered letter even the postman scored out the address and directed it to be served at Dadri. Moreover, it cannot accepted that the tenant would refuse to accept the service so as to jeopardise his very means of livelihood. The order of the Rent Controller is accordingly reversed. The case would now go back to the Rent Controller, Charkhi Dadri for further proceeding in accordance with law and the parties have been directed to appear before him on 26th March, 1985. No costs.
