The original petition is filed, to direct the Court of the Munsiff, South Paravoor, to consider and dispose of O.S.No.26/2021 (Ext.P1) within a time frame.
Pursuant to the order dated 07.04.2022, passed by this Court, the learned Munsiff, South Paravoor, by communication dated 21.04.2022, has informed this Court that the suit has been filed to set aside the final decree in F.D.A.No.937/1997. The service of notice on the fifth defendant is not complete. The court below would make an endeavour to dispose of the suit within six months, after the vacation.
Heard; Sri. M.R.Sasith, the learned counsel appearing for the petitioner and Smt. Shobhana Dinakaran, learned counsel appearing for the first respondent.
In the light of the pleadings and materials on record and after perusing the communication of the learned Munsiff, in exercise of the supervisory powers of this Court under Article 227 of the Constitution of India, I direct the Court of the Munsiff, South Paravoor, to consider and dispose of O.S.No.26/2021, in accordance with law, as expeditiously as possible, at any rate, within a period of three months, after the completion of the pre-trial steps.
The original petition is ordered accordingly.
