Judgment
This matter is taken up through hybrid mode.
Alleging non compliance of the order dated 01.10.2019 passed in W.P.(C) No. 18194 of 2019, the petitioners have filed this contempt petition.
As it appears, this Court while disposing of the writ petition directed opposite party no.2 to dispose of the application filed by the petitioners under Section 33-C (1) of the Industrial Disputes Act, 1947 on 25.02.2019 in accordance with law, as expeditiously as possible, preferably within a period of six weeks from the date of production of the certified copy of the order.
Mr. L. Samantaray, learned Additional Government Advocate contended that he has received instruction on 13.05.2020 to the effect that the certificate requisition has already been filed before the District Magistrate and Collector, Balasore for recovery of the dues of the workmen as computed by the Labour Court, Bhubaneswar in I.D. Misc. Case 30/17. Thereby, the order of this Court has been complied with.
Mr. N.K. Mishra, learned Senior Advocate appearing for the petitioners contended that nothing has been done till now and the workmen have not got any benefit out of the order passed by the Labour Court.
Mr. L. Samantaray, learned Additional Government Advocate wants to take further instruction in this matter.
