The writ petition has been filed praying for a direction to the respondents to prepare the bill and make payment to the petitioner for the work
regarding supply of materials, which has already been completed by him.
The respondents 3 and 4 have filed a counter affidavit saying that they have nothing to do with the preparation of bill.
A counter affidavit has been filed on behalf of respondents 1 and 2 wherein they have stated that the sanction of the 5th respondent is required and
a request has been made to the District Programme Co-Ordinator, MGNREGS, Alappuzha District for getting the check measurements by the Block
Assistant Executive Engineer as Ext.R2(B) and that the same is pending.
The 5th respondent has filed a statement in which the only objection is regarding the fact that the measurement was not carried out by an Engineer
not below the rank of Assistant Executive Engineer.
The learned counsel for the respondents 1 and 2 points out that in a similar situation, this Court has by judgment dated 08.04.2021 in W.P.(C)
No.27632/2020 directed the District Programme Co-Ordinator, MGNREGS, Alappuzha District to pass appropriate orders to get the check
measurements of the work referred to in the writ petition done within a month and further directed the respondents concerned to disburse the amounts
due to the petitioner within a month thereafter. In the facts of the case, I am inclined to issue a similar direction in this writ petition also.
The writ petition is hence disposed of directing the additional 7th respondent to get the check measurements of the work referred to in this writ petition
