The anticipatory bail application filed on behalf of petitioner- Gopal Yadav, who is apprehending his arrest in connection with Mirzachouki P.S. Case No.86 of 2021 for the offence registered under Sections 419, 420, 468 and 471 of the Indian Penal Code pending in the Court of learned S.D.J.M., Sahebganj is pressed into motion.
It is submitted by the learned counsel on behalf of petitioner that the allegation against the petitioner as disclosed in the F.I.R. is that he is the owner of truck bearing No. BR-01GD-0654 but he was plying the said truck under a different registration No. BR-01GE-7298. It is further submitted that this was being done in order to evade payment of bank installment. It is also submitted by the learned counsel for the petitioner that he is a bona fide transporter and he has no criminal antecedent. It is also submitted that he has no knowledge about the said vehicle which is said to have been used.
Learned A.P.P. opposed the prayer for anticipatory bail.
Considering the submissions made, the anticipatory bail application is allowed. Accordingly, the petitioner, namely, Gopal Yadav is directed to surrender before the learned trial court within a period of four weeks and on such surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Sahebganj and with a further condition of security deposit of Rs25000/- in connection with Mirzachouki P.S. Case No.86 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
