Judgment
Akil Kureshi, J
Petitioner is serving in a Government school. He has been posted at Betaga H.S. School, Santirbazar under deputation under an order dated 16.11.2020. His grievance is that at the said place, after he reported for duty and started discharging his duties, an untoward incident took place on 14.12.2020. According to the petitioner, when he was present at the teachers' room of this school, two other teachers of the school treated him very badly. According to the petitioner, these teachers not only misbehaved with him, they also acted violently, falling short of physical assault. The petitioner complained about the said incident to the Director of the School Education and requested to transfer him from the said school and to post him anywhere else on the ground that he was extremely disturbed and traumatized by the said incident and was therefore not possible for him to continue to discharge his duties at the said school. Since this request of the petitioner has not been redressed despite several reminders and subsequent representations, the petitioner has filed this petition.
Such individual incidents of disharmony between colleagues and staff members without there being anything further, cannot be a ground for the High Court to interfere in the course of administration. In what manner the administration should address the alleged incident and to resolve the issues, must be left for the administration to decide. In the writ jurisdiction, High Court would not interfere since the same would virtually amount to running the State administration.
Petition is dismissed.
