Judgment
Arindam Lodh, J
Heard Mr. S. Datta, learned counsel appearing for the petitioner. Also heard Mr. B. Majumder, learned C.G.C appearing for the respondent Nos. 2, 3 and 4.
Mr. Majumder, learned C.G.C has submitted that the Provident Fund Organisation has already decided to release the amount out of provident fund already deposited in favour of the petitioner which is lying with the organisation. Mr. Majumder has further submitted that the accumulated amount shall be released within a period of 3 (three) days from today.
At this juncture, Mr. Datta, learned counsel appearing for the petitioner has submitted that the respondent-Corporation has not released the gratuity amount. However, Mr. Datta has fairly submitted that an appeal has been preferred by the respondent No. 2 and 3 before the Division Bench of this Court regarding the gratuity amount.
Since, the matter of payment of gratuity is in seisin before the Division Bench of this Court, I am not inclined to decide this matter at this stage.
Accordingly, the instant writ petition stands disposed.
