Judgment
THIS appeal arises against the order dated 12.12.1995 of the District Forum, Sambalpur in Case No. 129/95.
NON-delivery of the letter of the complainant to the addressee sent through M/s. Goodluck Commercial Service, Sambalpur is alleged to be the deficiency in service. The complainant''s case in brief is that on 25.8.1995 he sent a letter to Sri Bhagabat Prasad Mohanty, Minister, Planning, Co-ordination and Higher Education, Bhubaneswar through the appellant on payment of service charges Rs. 5/-. The same envelope was returned undelivered on 3.9.1995 with a plea that plot number of the house of Sri Mohanty was not mentioned.
We have heard the Counsel for both parties and we feel that the plea taken by the appellant is imaginary and cannot be sustainable as per law. It is unbelievable that the appellant could not locate the house of a Senior Cabinet Minister. It was only lack of interest and inefficiency in dealing the matter casually. The appellant has committed deficiency in service in not delivering the letter. It also not placed any material to show that in fact his man made an honest effort to find out the house.
WE do not find any infirmity with the order of the Court below. Hence, orders of Court below stands as it is. No cost. Mr. Justice D.M. Patnaik, President-I agree. Mr. Pramodnath Das, Member-I agree. Appeal dismissed.
