Goel Company and Another vs Shri Krishan Tractors

Jitendra Chauhan, J.—The present application has been moved by the applicant for the transfer of the Civil Suit titled ''M/s Krishna Tractors v. M/s Goel Oil Company''from the Court of learned Civil Judge (Senior Division), Hisar to the court of competent jurisdiction at Gurgaon.

Through the present application, the transfer of the suit for mandatory injunction and for rendition of accounts filed by the Respondent in question has been sought on the ground that the suit pending at Hisar involves the identical issue as involved in the suit pending at Gurgaon between the parties.

I have heard the learned Counsel for the parties.

From the perusal of the record, it emerges that the suit inquestion is at the final stage while the case pending at Gurgaon is at initial stage. The relief claimed in both the suits quite different. There is no nexus with the relief claimed by the parties in their respective suits.

In view of the above, I feel that no sufficient ground is made out for the transfer of the suit in question and accordingly, the present application is dismissed.
