The present application has been filed under Rule 11 read with Rule 153 of NCLT Rules, 2016 for condonation of delay and for further compliance of order dated 06.01.2022 passed by this Bench for restoration of the name of the company which was struck off by ROC. It is pleaded that compliance of the order dated 06.01.2022 could not be made due to third wave of corona virus, the applicant was not going well and was unable to contact his counsel and respondent ROC for restoration of name of company. The applicant deposited the cost of Rs. 10,000/- and communicated to ROC through a letter dated 04.06.2022 for restoration of the name of the company. ROC refused to entertain the same on the pretext that there was delay on the part of applicant. There is a ground for granting condonation of delay for approaching the ROC within the stipulated time. It is also stated by learned counsel for the applicant that he has also not received the copy of the order dated 06.01.2022 and it was directed to email the party concerned. Registry is directed to supply the certified copy of this order to the learned counsel within one week. Thereafter, he is at liberty to approach ROC to comply with the order dated 06.01.2022 within one month, subject to deposit of other cost of Rs. 5,000/- in favour of “Pay and Accounts Officer, Ministry of Corporate Affairs” by the applicant. Thus, IA No. 225/2022 is allowed and disposed of accordingly.
