Issue notice to the respondents, returnable on 07.06.2022. The learned AGP waives service for respondent nos.1 to 3 and learned Counsel Mr. Ajit Kadethankar waives service for respondent no.4. Hamdast allowed.
Heard the learned Senior Counsel for the petitioner as well as the learned Counsel for the respondent no.4 i.e. Election Officer.
The learned Senior Counsel for the petitioner submits that despite earlier disqualification of respondent no.5 who is a candidate for ongoing election which is to be held tomorrow i.e. 05.06.2022, her nomination form is again accepted without contesting the objection raised by the petitioner.
. However, the voting is fixed tomorrow and therefore, it is not proper to stay the entire election process. At the most, the matter can be kept before the regular Court for due consideration on urgent basis on 07.06.2022. Further, considering the submissions of the learned Senior Counsel for the petitioner, I am of the opinion that if respondent no.5 got elected, then it would be subject to the outcome of this petition.
