Judgment
B.V. Pinto, J.—These three petitions are filed seeking to quash the proceedings in Crime No. 83 of 2012 registered on 22-12-2012 by Market Yard Police Station, Raichur for the offences under Sections 504, 506, 420 and 149 of the Indian Penal Code, 1860 and u/s 3(1)(x) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989. It is the case of the complainant that after purchase of the plot Nos. 7 and 8 bearing MPL No. 12-6-1045/07 and 12-6-1045/08, respectively on Chandra Banda Road in Bujang Rao Colony, Raichur, the petitioners have damaged the survey stones and when the complainant went to question them, the petitioners abused him in the name of his caste and also caused loss to an extent of Rs. 26,000/-, thereby they are alleged to have committed the aforesaid offences.
Learned Counsel for the petitioners and respondent 2 submit that the matter between the parties has been settled. Hence, they pray that the proceedings as against the petitioners be quashed.
Respondent 2-Narasappa is present personally and he submits that he has no objections for quashing the proceedings against the petitioners.
Heard Sri Sanjay A. Patil, learned Additional State Public Prosecutor for the respondent 1-State. He has submitted that an amicable settlement has been arrived at regarding the dispute between the petitioners and the respondents.
In view of the same, the proceedings in Crime No. 83 of 2012 of Market Yard Police Station, Raichur, is hereby quashed insofar as the petitioners are concerned. Petitions are allowed.
