By means of present writ petition, the petitioner has

sought quashing of the FIR dated 18.11.2016 registered as Case

Crime No. 315 of 2016, for the offence punishable under section

308 IPC, registered at P.S. Kotdwara, District Pauri Garhwal.

Learned counsel for the petitioner, and learned

counsel for respondent no. 3 (complainant) state that parties

have settled their dispute amicably and there is no dispute

between the petitioner and respondent no. 3. It is further

submitted that the complainant does not want to prosecute the

petitioner. A compounding application no. 2491 of 2017, is filed

supported by an affidavit.

Girish Chandra Dhyani (petitioner) identified by

his counsel Mr. Navnish Negi, Advocate, and Smt. Abha

(respondent no. 3) identified by his counsel Mr. T.S. Phartiyal,

Advocate are present in the Court and submit that they have

entered into compromise and decided to live together happily

as husband and wife. The complainant (respondent no. 3) does

not want to prosecute the petitioner.

In view of above, the writ petition is allowed. FIR

dated 18.11.2016 registered as Case Crime No. 315 of 2016, for

the offence punishable under section 308 IPC, registered at P.S.

Kotdwara, District Pauri Garhwal, is hereby quashed.

(Compounding application no. 2491 of 2017 stands disposed

of).
