Judgment

The petitioner herein is the defendant in O.S.No.78/2016 and the appellant in A.S.No.1/2022 of the Sub Court, Sulthan Bathery. The appeal was dismissed on 29.02.2024. Though, the petitioner filed an application for issuance of certified copy, the same has not been issued. Now, the E.P. stands posted for delivery on 20.03.2024. Learned counsel seeks a breathing time to pursue such remedy as against the dismissal of the appeal, after obtaining certified copy and seeks to stay further proceedings in E.P. until then.
In view of the limited relief sought for, notice to the respondents are dispensed with.
In the afore-referred facts and circumstances, the delivery of the property in execution of the decree in O.S.No.78/2016, shall be kept in abeyance for a period of three weeks. There will be a direction to the Sub Court, Sulthan Bathery, to issue certified copy of the judgment in A.S.No.1/2022, as expeditiously as possible.
The Original Petition is disposed of, as above.
