Judgment

This appeal has been preferred by the accused No.7 in C.C.No.1/2003 on the files of the Enquiry Commissioner and Special Judge, Thrissur (for short 'the court below'), challenging the judgment dated 03.09.2011, convicting him under Section 120B of the Indian Penal Code. He was sentenced to undergo rigorous imprisonment for a period of six months and to pay a fine of Rs.1,000/- in default to suffer rigorous imprisonment for a period of one month.
During the pendency of the appeal, the accused No.7/ original appellant died. His legal heirs have been impleaded as additional appellant Nos. 2 and 3.
Additional appellant Nos. 2 and 3 filed an affidavit stating that they do not want to prosecute the appeal on merits and they are prepared to deposit the fine.
Hence, this appeal is closed with liberty to the appellant Nos. 2 and 3 to deposit the fine amount before the court below within one month from today, failing which, appropriate legal action shall be initiated for realising the fine amount from them.
