THIS appeal is directed against the order passed by the District Forum, Thrissur, in O.P. No. 1091/1995.

WE heard the Counsels for the appellant and the respondent. Admittedly the fault was reported on 16.9.1995. But it was rectified only on 23.9.1995. So also a fault on 9.10.1995 was reported but it was rectified only on 18.10.1995. This could be seen from Ext. Al. It is the case of the appellant that it is on account of cable fault which was beyond the control of the appellant that delay occurred in attending to the faults reported on 16.9.1995 and 9.10.1995. However, no material has been produced to show that they made any attempt to rectify the faults earlier but they could not do it for reasons beyond their control. In the circumstances we are unable to hold that the finding entered by the District Forum that there is deficiency in service is wrong. There is a duty cast on the department to attend to the faults at the earliest. The act of giving rebate is no justification to deny the service to the consumer. In these circumstances we do not find sufficient ground to interfere with the order passed by the District Forum. WE accordingly dismiss the appeal. Appeal dismissed.
