The Management of Sri Bharathi Mills has filed this intra-court Appeal aggrieved against the interim order passed by the learned Single Judge inW.M.P.No.34364 of 2016 in W.P.No.3635 of 2015, by which, the Labour Court's Award was challenged by the Management.
The learned Single Judge, by the interim order impugned before us, dated 20.3.2017, directed the Management to pay a sum of Rs.5,00,000/-against the backwages to the Respondent/Workman P.Mannagati.
A co-ordinate Bench of this Court, while issuing notice in the present Appeal, had passed an interim order on 5.7.2017, keeping the payment to the Respondent/Workman in abeyance as the matter was referred to Mediation Centre of this court, however, the Mediation failed.
The learned counsel for the Appellant/Management, Mr.R.Parthiban informed the court today that the Writ Petition itself is coming up for disposal on 6.12.2019 itself.
In view of this, we are not inclined to pass any further order. Therefore, we dispose of this Appeal with a request to the learned Single Judge to dispose of the Writ Petition itself as expeditiously as possible. The interim order granted by the co-ordinate Bench on 5.7.2017 shall continue till the disposal of the Writ Petition by the learned Single Judge. No costs. Consequently, the connected Miscellaneous Petition is also closed.
