Judgment

The General Manager, District Industries Centre, Palakkad, is before us.
The dispute in this case arose out of a higher purchase agreement. It is stated in the appeal that the respondent was allotted a land and the entire payment has been effected by the allottee. Whereas, the respondent claims that due to the reconstitution of the Board of Directors, no transfer was effected. The appellants claims that 51 shares has been transferred. Therefore, it has to be treated as a transfer. There was an issue regarding the application of the Rules before a learned Single Judge of this Court. The learned Single Judge taking note the then existing Rule, directed to take a decision on issuance of patta. In the meanwhile, new Rule came into force as per G.O.(P)No.309/2023/RD Thiruvananthapuram dated 11.12.2023.
Having considered the facts and circumstances of the case, a final decision shall be taken in this matter, after adverting to new Rule as well. We, reserve all the liberties to the respondent to challenge any decision thereon.
With the above liberty, this writ appeal is disposed of directing the appellants to take a decision in accordance with the present Rules, within two months from the date of receipt of a copy of this judgment.
