Judgment
B.S. Verma, J.—Heard learned Counsel for the parties.
By means of this writ petition, Petitioner has sought writ in the nature of certiorari quashing the impugned order dated 13.12.2010 (Annexure No. 3 to the writ petition), passed by Respondent No. 2, whereby Respondent No. 2 has approved rates offered by Respondents No. 4 and 5 for printing of certain books.
The grievance of the Petitioner is that the Petitioner being the lowest bidder, pertaining to books mentioned at serial No. 43 to 52 in the order dated 13.12.2010, the contract was awarded to Respondents No. 4 and 5. Comparative chart for printing of books has been annexed as annexure No. 1 to the supplementary affidavit, filed on behalf of the Petitioner today in the Court and has also been as annexure No. 2 to the writ petition. The supplementary affidavit, filed today on behalf of the Petitioner be taken on record.
Learned Counsel for the Petitioner relying on Uttarakhand Procurement Rules, 2008, urged that tender ought to have been awarded to the lowest bidder.
After perusal of the comparative chart, it shows that the tender for printing of books, mentioned as serial No. 43 to 50, has been awarded to Respondent No. 4 and books mentioned at serial No. 51 and 52 to Respondent No. 5.
Learned Brief Holder for the State, prays for and is allowed to file counter affidavit within a period of four weeks.
Issue notices to Respondents No. 4 and 5, returnable within four weeks.
List thereafter.
In view of the above facts, as an interim measure it is directed that till the next date of listing, tender for printing of books, mentioned at serial No. 43 to 52 in the impugned order dated 13.12.2010 (Annexure No. 3 to the writ petition), shall not be finalized, if not already finalized. (Interim relief application stands disposed of).
