Geeta Singh vs Rakesh Bahadur Singh

Sibghat Ullah Khan, J.—In Case No. 829 of 2012 Rakesh Bahadur Singh v. Smt. Geeta Singh under section 9 of Hindu Marriage Act pending before Family Court, Allahabad. Wife petitioner who is opposite party before Family Court has filed an application for interim maintenance under section 24 of Hindu Marriage Act on 11.12.2012. The prayer is that the said application may be directed to be decided expeditiously. There is already a strong order in favour of the petitioner dated 3.4.2013 passed by the Family Court. However, from the perusal of order sheet which is Annexure3 to the writ petition, it appears that on 5.1.2013 and 11.2.2013 advocates created disturbance before the Family Court, Allahabad hence cases could not be heard. Same thing happened on 8.4.2013 when advocates were on strike. As Shri V.M.Sharma who is arguing the writ petition is also an advocate hence he will have to take vicarious responsibility for the action of his colleagues before Family Court, Allahabad. It is very unfair that the advocates are disturbing the working of Family Court, Allahabad. In view of this no direction for expeditious disposal can be issued.

Writ petition is dismissed.
