V.K. Sharma, J.—Consequent upon rejection of her case for grant of employment on compassionate grounds vide letter dated 11.04.2011, Annexure P-I, the Petitioner, who is divorced daughter of the deceased employee, late Shri Dugra Singh, who while in the employment of the Respondent-department had died in harness on 06.05.2008, has filed the present petition on the following prayer:

That Annexure P-1 may be quashed and the Respondent may be ordered to give compassionate appointment to the Petitioner so that she may look after her old and ailing mother (widow of the deceased employee).

There is no reply as yet.

The text of the aforesaid letter dated 11.04.2011, Annexure P-I, addressed by the Superintending Engineer, I & PH Circle, Sundernagar to the Executive Engineer, I & PH Division Baggi, a copy of which has been endorsed to the Petitioner is as under:

In this connection, it is intimated by the higher office that in future only those cases covered under Govt. instruction may be sent to his office. This case not covered under the Govt. instruction, hence the case as received vide letter under reference is returned herewith.

Indisputably, a married daughter including a divorcee is not covered under the scheme formulated by the State Government for grant of employment on compassionate grounds to the dependents of the State Government employees dying in harness. Thus, no fault can be found with rejection of the prayer of the Petitioner in this regard vide the aforesaid letter dated 11.04.2011, Annexure P-I. Accordingly, the petition is dismissed, being without any merit.
